This “Privacy Policy” explains how Factor4 collects, uses, discloses, and otherwise processes personal data on behalf of our customers – typically, merchants (any, a “Merchant”) – in connection with our application, [Factor4], which runs on the Clover Point of Sale system (“Clover POS”). This Privacy Policy does not apply to Company’s privacy practices in any other context.   Company’s processing of personal data in connection with our application is governed by this Privacy Policy and our agreements with Merchants. In the event of any conflict between this Privacy Policy and a customer agreement, the customer agreement will control to the extent permitted by applicable law.

This Privacy Policy is not a substitute for any privacy policy that a Merchant may be required to provide to their customers, personnel, or other individuals.

Information Clover collects

We may collect personal data from or on behalf of Merchants. Merchants determine the scope of the personal data transferred to us or that we collect, and the information we receive may vary by Merchant. Typically, the information we collect on behalf of Merchants includes:

Information that we collect when a customer for a Merchant makes a payment

When a customer makes a payment via a Clover POS, we collect information about the transaction, which may include personal data. Information about transactions includes the payment card used, name associated with the payment card, the location of the merchant’s store, date and time of the transaction, transaction amount, and information about the goods or services purchased in the transaction.

Additional information that customers of the Merchant provide through the Clover POS ancillary to a payment

We may collect additional information ancillary to the payment. This information may include:

• Customers’ email address or phone number, such as when the customer chooses to receive an electronic receipt 
• Customers’ marketing preferences, such as whether the customer wishes to receive marketing communications or newsletters
• Information about participating customers’ activity in a merchant loyalty program
• Customers’ physical address, where needed for delivery of goods or services
• Other information the customer provides, such as birthdate, interests or preferences, reviews, and feedback

Factor4 will never sell or transfer your personal information to any unaffiliated person for any reason. Personal and Non-Personal Information – When using our web site, you may be asked to provide certain personal information about yourself for the purposes of purchasing, sending or redeeming a gift certificate, entering a contest, responding to a survey, etc.

In general, Factor4 will only use this information to comply with the purpose for which such information was requested. Factor4 may, from time to time, use this information to send you information about new and exciting products and services Factor4 offers. Factor4 will not share with or rent, sell or lease your personal information to any unaffiliated person or entity without your express consent. At any time, you may revoke this consent by contacting us at the address provided below. We may also request and collect non-personally identifiable information about you, such as gender, age, hobbies, or buying preferences. We may use this data to improve our site and to send you information that may be of interest to you. We may use this data to enhance your experience at our site, showing you content and promotional messages that we think you might be interested in, based on your preferences. We may also share this information with others, such as advertisers interested in advertising on the Factor4gift.com web site, in aggregate, anonymous form, which means that the information will not contain any personally identifiable information about you or any other person. 

This information, which is sometimes called “clickstream” data, can be collected and stored by a Web site’s server. Clickstream data can tell us the type of computer and browsing software you use, the address of the Web site from which you linked to the Factor4 web site, and in some instances, your e-mail address. We may use clickstream data to determine how much time visitors spend on each page of our site and how they navigate throughout our site. We do not track signals used by web browsers. We will only use this information to improve the Factor4 web site. Any collection or use of clickstream data will be anonymous and aggregate, and will not contain any personal information.

Consent to Processing By providing any personal information to this site, users, including without limitation users in the European Union, fully understand and unambiguously consent to the collection and processing of such information in the United States.

Other Sites Our site contains links to other sites. Other sites may also reference or link to our site. Factor4 is not responsible for the privacy practices or the content of such other sites.  This app does not collect cookies or advertise to customers.

Supplemental Information: We may supplement the information that you provide to us with information that is received from third parties. Choice Opt-Out – If we ever send you information by e-mail concerning new products or services, we will provide you with an e-mail address by which you may request no future notices. Disclosure of Information – Factor4, LLC will not sell or rent your personally identifiable information to anyone. We do not provide individual information to our advertisers. We will occasionally provide general demographic information of our site to perspective advertisers, but nothing that specifically references individual members or consumers. We will only disclose your personal information when: We have your consent to share the information; We respond to subpoenas, court orders or legal process; We explicitly specify that we will be sharing your information, such in the case of joint promotion, sweepstakes, or giveaways.  3rd parties aren’t used nor do we share personal information with them. 

We will keep your information stored in our system unless a customer wants their information removed.   The best way to do this is to send an email to [email protected] or call 484-471-3963. 

The only information we collect are name, phone number, email, birthday and anniversary.   The information is only collected if they choose to enter it in the app.    We only collect data from customers that are 18+.

We have a site called getyourbalance.com where data can be edited or added.  We do not collect data from minors. If the privacy policy changes, we will update the app and make note in the app changes.
